Excerpt: Fort Abraham Lincoln State Park is located seven miles (11 km) south of Mandan, North Dakota. The park is home to On-A-Slant Indian Village, the blockhouses and the Custer house. President Theodore Roosevelt signed the deed to the land to the state in 1907 as Fort Abraham Lincoln State Park. The Mandan Indian tribe established a village at the confluence of the Missoui and Heart Rivers in about 1575. They built earthlodges and thrived in their community by hunting bison and growing a number of crops. Two hundred years later, an outbreak of smallpox caused the Mandan population to significantly decrease. The Mandan resettled, and in the 1870s the area along the west banks of the Missouri, the same location where the Mandan tribe had established their village, a military post was built in June 1872 by two companies of the 6th U.S. Infantry under Lt. Col. Daniel Huston, Jr. as Fort McKeen, opposite Bismarck, Dakota Territory. The three-company infantry post's name was changed to Fort Abraham Lincoln on November 19, 1872, and expanded to the south to include a cavalry post accommodating six companies. Among the 78 permanent wooden structures at Fort Lincoln were a post office, telegraph office, barracks for nine companies, seven officers quarters, six cavalry stables, a guardhouse, granary, quartermaster storehouse, bakery, hospital, laundress quarters, and log scouts' quarters. Water was supplied to the fort by hauling it from Missouri River in wagons, while wood was supplied by contract. By 1873, the 7th Ca... More: http://booksllc.net/?id=2107848

Excerpt: Britvic Soft Drinks Ltd v Messer UK Ltd Britvic Soft Drinks Ltd v Messer UK Ltd EWCA Civ 548 is a notable English contract law case, concerning the application of the Unfair Contract Terms Act 1977 in the context of consumer protection and a supply chain. Facts Messer UK Ltd supplied Britvic with carbon dioxide for its drinks. It was contaminated with benzene, a carcinogen. Britvic had to recall its products and it sued Messer to recover its costs, arguing that it was in breach of contract. A term in the contract limited liability of Messer under s 14 of the Sale of Goods Act 1979 (which by virtue of UCTA 1977 can only be limited as it satisfies the requirement of reasonableness). The judge found that the only relevant express term in the supply agreement was that the carbon dioxide would conform with British Standard 4105. But the implied term under Sale of Goods Act 1979 s 14 also applied. Breach of both terms allowed the recovery of damages. Messer appealed, arguing that BS 4105 could not be regarded as containing an express term that gave rise to damages and that the term limiting s 14 did in fact satisfy the reasonableness test. Judgment Mance LJ dismissed the appeal and held in favour of Britvic. The judge had in fact been wrong on the first point, that BS 4105 contained an express term relevant...

It generated electricity from 1952 to 1981. Since 2000 the station's building has been used to house the Tate Modern art museum. History The station was commissioned following a power shortage in 1947. The building was designed by Sir Giles Gilbert Scott , the designer of Liverpool Cathedral , Battersea Power Station and the Red telephone box . The building is a 200 m (660 ft) long, steel framed , brick clad building with a substantial central chimney which stands at 99 m (325 ft). The chimney's height was limited to less than the spire of St Paul's Cathedral , which already stood on the direct opposite side of the river. Despite strong local opposition, Scott's design was completed and accepted within a year. Construction work was completed in two phases, and was not entirely completed until 1963. The western portion of the building was completed first and started generating power in 1952. The final structure roughly divided the building into three - the huge main turbine hall in the centre, with the smaller boiler room to one side and the switching room to the other. The station had four oil-fired generators . Rising oil prices made the station uneconomic, resulting in its closure in 19...
